1. Introduction

These Terms of Use (hereinafter referred to as "these Terms") apply to all actions taken by members when using the services provided by ComedyJapanese™ (hereinafter referred to as "the Company").

These Terms may be changed by the operating company at its discretion without prior notice.

By using this service, members are deemed to have agreed to these Terms. The website related to these Terms may change or suspend the content of the service or discontinue service provision for any reason without prior notice.

2. Scope of these Terms

These Terms and other terms and conditions stipulate the terms of use for this service on this website. Regardless of their names, other terms and conditions constitute a part of these Terms. In case of any discrepancy between the provisions of these Terms and those of other terms and conditions, the provisions of the other terms and conditions shall take precedence.

3. Amendment of these Terms

If a member uses this service after the amended Terms take effect, they are considered to have agreed to all the provisions of the amended Terms.

5. About Members

(1) Members may use various services in accordance with the conditions set by the Company. However, registration of additional matters as determined by the Company may be required.

(2) Members may not transfer, lend, pledge, or otherwise dispose of any rights acquired through their membership status and use of the services to the Company.

(3) Members shall use this service at their own risk and assume full responsibility for all actions taken and their consequences.

(4) Members are responsible for information they post, such as comments, images, videos, etc., through the use of this service. The Company bears no responsibility for the content of information posted by members through the use of this service.

(5) If a member damages someone's reputation, infringes on their privacy, discloses third-party personal information without permission, engages in activities in violation of copyright law (Law No. 48 of 1970), or otherwise infringes on the rights of others, the member shall resolve such issues at their own responsibility and expense, and the Company shall not be held liable.

(6) Members acknowledge that the Company is not obligated to retain information posted by members through the use of this service and agree to appropriately back up necessary posted information.

6. Membership Registration

(1) Individuals who have agreed to these Terms and completed the prescribed registration process will become members.

Membership registration must be completed by the individual who will become the member, and registration by proxy is not allowed. The Company may refuse membership applications from individuals who have had their membership revoked in the past or individuals whom the Company deems unsuitable.

(2) When entering member information, please read the instructions carefully and accurately enter the required information in the designated input form.

(3) Each member is allowed to possess only one account. It is not allowed for one person to possess multiple accounts, nor is it allowed for multiple people to jointly possess one account, except as otherwise permitted by the Company.

(4) Members may not transfer or lend their account to a third party.

(5) Members must register an email address under their own management as their registered email address, and if that registered email address is no longer under their management, they must change it to another email address under their own management.

(6) Members must make efforts to prevent the unauthorized use of their registered email address and password and are responsible for their management.

(7) Except in cases where the Company is intentionally or grossly negligent, the Company shall not be liable for any damages or other consequences arising from the use of a registered email address or password by a third party.

7. Withdrawal

If a member wishes to withdraw, they must notify the Company of their withdrawal using the Company's designated method. When a member withdraws from this service, they will lose all rights related to this service, including posted comments, videos, and other content. Additionally, the Company may, at its discretion, force a member to withdraw from this service and deny them the use of this service if the member engages in any of the following actions:

(1) The member engages in actions that violate laws or these Terms.

(2) The member engages in fraudulent activities related to the use of the service.

(3) In other cases where the Company deems it appropriate.

8. Prohibited Actions

When using this service, the following actions are prohibited:

(1) Actions that infringe or may infringe upon the intellectual property rights, such as copyrights and trademarks, of the Company, members, or any other third party.

(2) Actions that infringe or may infringe upon the property, privacy, or portrait rights of the Company, members, or any other third party.

(3) Actions that unjustly discriminate against, defame, or encourage unfair discrimination against the Company, members, or any other third party, or actions that damage their reputation or credibility.

(4) Actions that are deemed to have a detrimental impact on the character formation of minors or that violate public order and morals, among other acts.

(5) Providing false information.

(6) Engaging in or potentially engaging in criminal activities related to fraud, the abuse of controlled substances, child prostitution, illegal trading of savings accounts and mobile phones, or other crimes.

(7) Conducting or soliciting participation in illegal gambling activities and gambling.

(8) Undertaking, mediating, or inducing illegal activities (e.g., transfer of firearms, manufacturing explosives, providing child pornography, forgery of public documents, murder, threats, etc.).

(9) Sending or posting harmful computer programs, emails, etc.

(10) Unauthorized access to the Company's servers or other computers.

(11) Scraping of this service without prior consent from the Company.

(12) Unauthorized alteration or deletion of information stored in the Company's facilities.

(13) Spamming, including:

- Posting the same or similar text multiple times in areas where posting is allowed on this site or sending it in messages.

- Listing unrelated or loosely related terms in areas where posting is allowed on this site, or posting excessively long or voluminous text or terms.

- Posting the same URL multiple times in areas where posting is allowed on this site or sending it in messages.

- Other activities deemed as spam by the Company.

- Sending or posting harmful computer programs, such as viruses.

(14) Actions that burden the Company's servers or those of others, or actions that disrupt the operation of this service or network systems, or actions that may result in such disruption.

(15) Possessing multiple accounts for one person or jointly holding one account for multiple people, except as otherwise permitted by the Company.

(16) Any actions deemed by the Company to have the primary purpose of seeking to meet the opposite sex, etc.

(17) Using the service for the purpose of sexual activities, lewd acts, etc.

(18) Actions related to posting information, including but not limited to lewd, child pornography, or child abuse content (hereinafter referred to as "such information"), involving any of the following:

- Posting or displaying such information.

- Selling media containing such information.

- Posting or displaying advertisements that suggest the transmission, display, or sale of media containing such information.

(19) Content that is inappropriate for minors.

(20) Posting information in reviews, including but not limited to:

- Information that defames or insults the subject of the review (including staff, authors, etc.).

- Information that can identify individuals, such as names, addresses, workplaces, phone numbers, etc., when compared with information related to the review subject.

- Information unrelated to the review subject.

- Information that is difficult to fact-check for accuracy or contains false information.

- Information related to matters that should be reported to appropriate public authorities, such as hygiene issues.

- Information related to disputes or complaints with the review subject.

- Other information deemed inappropriate by the Company.

(21) Posting or sending emails of information with the intent to buy, sell, exchange (including advertising, announcements, and solicitations) goods or services for profit or non-profit purposes, except as otherwise permitted by the Company.

(22) Actions that the Company deems to violate laws, public order and morals, these Terms of Use, or other terms and conditions, or actions that infringe upon the rights of others.

(23) Any other actions deemed inappropriate by the Company.

9. Usage Fees

Regardless of whether it is a lump-sum payment or installment payment, the fees vary depending on the course content. When purchasing a permanent license product, the buyer has permanent access to the product. However, the Company has the authority to change or delete the distribution methods and platforms for educational materials without the consent of the members. In the event of changes or deletions, the Company will notify the buyer (either through the website or by contacting the registered email address). Along with a 3-month download validity period, the purchased content will be distributed as data.

10. Rights Regarding Posted Content and Information

Members who post information, including posted content, using this service guarantee to the Company that such posted content and information do not infringe upon the rights of third parties. In the event of any dispute with a third party, the member shall resolve the issue at their own expense and responsibility, ensuring that the Company is not inconvenienced or harmed in any way.

11. Licensing and Usage of Posted Content

The rights (including copyright and moral rights) to comments, images, videos, and other information posted using this service belong to the creating member. The Company may use the information posted by members within the scope necessary for the smooth provision of this service, the development, improvement, and maintenance of the Company's systems. The Company may omit part of the information or the member's name when using the information. When the Company uses the information posted content, it will not use it in a manner that exceeds the scope of information made publicly available by the member.

12. Disclaimer

(1) The Company does not interfere with members' communications or activities. In the event of a dispute between members, it is the responsibility of the members to resolve it, and the Company bears no responsibility.

(2) The Company is not responsible for any damages resulting from additions, modifications, interruptions, or terminations of the content of this service. This also applies in cases of reduced display speed or malfunctions due to excessive access or other unforeseen factors.

(3) The Company is not obligated to monitor or store information such as comments, images, videos, etc., posted by members.

(4) The Company is not responsible for the legality, morality, reliability, or accuracy of information posted by members. The Company is also not responsible for ensuring that the content posted by members conforms to the internal rules of the corporation, organization, etc., to which the member belongs.

(5) The Company may view, save, or disclose the contents of posted information if:

- The member has given consent for such viewing, etc.

- It is necessary to clarify and resolve technical issues with this service.

- A formal inquiry based on laws is received from public agencies such as courts or the police.

- The Company deems it necessary to confirm the content of information, such as diaries, due to acts that violate these Terms of Use or those that may potentially do so.

- There is an urgent need to protect human life, physical safety, property, etc., as determined by the Company.

- It is otherwise necessary for the proper operation of this site.

(6) In cases where the Company has reasonable grounds to believe that an act or potential act in violation of these Terms of Use or other terms and conditions has occurred, the Company may take measures such as the forced withdrawal of the member responsible for the act, deletion of all or part of the content, and changes in the scope of public availability of the posted content, among others. However, the Company bears no responsibility for any damages resulting from these actions.

(7) The Company bears no responsibility for any damages resulting from information provided to members by the Company through appropriate information provision or advice.

(8) The Company does not guarantee that emails or content sent from the Company's webpages, servers, domains, etc., are free of harmful elements such as computer viruses.

13. Deletion Rights of the Company

In the following cases, regardless of the legality or violation of the terms of posted content and information, the Company may take disadvantageous measures such as deleting or changing all or part of the related posted content and information:

(1) When posted content and information containing images of people (regardless of whether they are real individuals or characters from manga, anime, etc.) in a state of nudity (lacking some or all clothing) are posted.

(2) When a public institution or expert (including but not limited to government bodies, reliable verification organizations specified in the Act on the Limitation of Liability for Damages of Specified Telecommunications Service Providers, Internet Hotline Centers, lawyers, etc.) provides feedback or opinions regarding the illegality, violation of public order and morals, or infringement of the rights of others in relation to posted content and information.

(3) When a person claiming to be a rights holder reports that the posted content and information infringes upon their rights. However, this is limited to cases where the person claiming to be a rights holder presents reasonable evidence to establish that they are the rights holder, and the Company, after careful consideration, determines that they are indeed the rights holder.
